NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by Campbell County.

REQUEST FOR RELEASE OF FUNDS

On or about May 23, 2007 Campbell County will submit a request to the Wyoming Business Council (WBC) for the release of funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake a project known as the Recluse Community Hall Historic Preservation and Renovation Project, for the purpose of: preserving the historical and aesthetic integrity of the Recluse Hall; building renovation bringing all aspects up to applicable code; constructing an addition including a library/conference room, storage, restrooms, and an extension on the kitchen; replacing the roof; and building a porch providing handicapped access.

FINDING OF NO SIGNIFICANT IMPACT

Campbell County has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Campbell County Commissioners Office, 500 S. Gillette Avenue, Suite 1100, Gillette, WY 82716 and may be examined or copied weekdays 8:00 A.M. to 4:00 P.M. Accommodations will be made for the individually disabled to examine these Environmental Review Records upon request, 307-682-7283.

PUBLIC COMMENTS

Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the Campbell County Commissioner’s Office. All comments received by May 23, 2007 will be considered by Campbell County prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

 

RELEASE OF FUNDS

Campbell County certifies to WBC that Christopher R. Knapp in his capacity as Campbell County Commissioner consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. WBC’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Recluse Community Trust to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

WBC will accept objections to its release of funds and Campbell County’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of Campbell County; (b) Campbell County has omitted a step or failed to make a decision of finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by WBC; or (d) another Federal agency pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures in 24 CFR Part 58 and shall be addressed to WBC at 214 W. 15th St.,Cheyenne, WY 82002. Potential objectors should contact WBC to verify the actual last day of the objection period.
